These terms and conditions apply to the entire contents of the Website under the domain name www.heritage.norfolk.gov.uk, including the datasets, records and catalogues contained within it ('the Website') and to any correspondence by e-mail between Norfolk County Council acting through its operating department Norfolk Historic Environment Service ('NHES') and the user ('You'). Please read these terms carefully before using the Website. By accessing any part of the Website, You will be deemed to accept these terms and conditions in full. If You do not accept these terms and conditions in full, You must leave the Website immediately. This notice is issued by NHES.
NHES levies no charge to use its Website when used according to the terms and conditions contained herein. It is the aim of NHES to provide integrated access to a variety of datasets at no cost to You, and without cumbersome login procedures. Therefore, You may access the Website without registering Your details with NHES. This aim can only be achieved if the organisations that supply data can be assured that their own rights are protected. Consequently, use of the Website is covered by a variety of legal instruments to protect NHES, You and those who supply data to NHES.
NHES may revise these terms and conditions at any time by updating this posting. You should check the Website from time to time to review the then current terms and conditions, because they are binding on You.
If any clause of these terms and conditions is held to be unenforceable in whole or in part, the other terms and the rest of the provisions shall continue to be valid and enforceable.
You are permitted to print, copy and download extracts from the Website and from the records and catalogues contained on it for Your own lawful non-commercial research or educational teaching purposes. You must obtain written permission from Norfolk Historic Environment Service, Union House, Gressenhall, Dereham, Norfolk NR20 4DR for any other use.
You are not permitted to modify any documents or related graphics on the Website in any way or to use any graphics on the Website separately from the corresponding text or to do anything to diminish the value of the content.
You are permitted to give access to any copies of documents contained on the Website, in whole or in part, only to parties who have obtained permission to use them. Permission must be sought from NHES.
You must acknowledge in any publication, whether printed, electronic, internet- based or broadcast, based wholly or partly on information obtained from the Website, NHES, the original depositor(s), illustrator(s) or photographer(s).
You must declare, in any publication, whether printed, electronic, internet-based or broadcast, based wholly or partly on information obtained from the Website, that those who carried out the original collection of the data bear no responsibility for its further analysis or interpretation.
You must supply free of charge to the NHES one copy of any published work based wholly or partly on the information obtained from the Website. Such publications must be supplied within 28 days of the date of publication and must be sent to Norfolk Historic Environment Service, Union House, Gressenhall, Dereham, Norfolk NR20 4DR. You must also supply on the same terms one copy of any unpublished work, such as undergraduate dissertations and Masters/Doctoral theses. Such work must be supplied within 3 months of the date of graduation.
You must notify the NHES of any incompleteness or errors You discover or believe You have discovered within the Website as soon as is reasonably practicable and provide all reasonable information to assist in rectifying the information as soon as is reasonably practicable.
You must abide by any conditions displayed on screen or otherwise notified, that may apply to the access to, or use of the datasets contained within the Website.
You accept that the NHES bears no legal responsibility for the accuracy, comprehensiveness or reliability of the Website or the information contained in it, and that the NHES accepts no liability for indirect, consequential, or incidental damages or losses arising from use of the Website.
The information contained in the Website is the product of many decades of scholarship by numerous archaeologists, local historians, collectors, analysts, antiquarians, fieldworkers, metal-detectorists and laboratory scientists. It is not possible to credit all of these people individually, or sometimes even identify them, but in making their data available for re-use, NHES acknowledges their contribution. At all times, NHES seeks to protect the intellectual property rights and copyright of the originators of data where that can reasonably be achieved. As a result, You acknowledge that:
a) All material on the Website is protected by copyright and other intellectual property rights (including without limitation photographs and graphical images). Specific copyright holders are identified in the appropriate pages and sections. In all other instances, copyright is retained by NHES. Links to materials on other servers should not be construed as a claim over them. All rights are reserved.
b) For the purposes of these terms and conditions, any use of extracts from the Website other than in accordance with Clause 2 for any purpose is prohibited. If You breach any of these terms and conditions, Your permission to use the Website automatically terminates and You must immediately destroy any downloaded or printed extracts from the Website.
c) Subject to Clause 2 no part of the Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without NHES' prior written permission.
d) The mapping is reproduced from Ordnance Survey material with the permission of Ordnance Survey on behalf of the Controller of Her Majesty's Stationary Office © Crown Copyright. e) Questions about copyright should be addressed to NHES.
4. Data Protection
You agree to preserve at all times the confidentiality of information pertaining to identifiable individuals that is recorded on the Website and in addition, where so requested, to preserve the confidentiality of information about, or supplied by, organisations recorded on the Website. In particular, You undertake not to use or attempt to use information on the Website to deliberately compromise or otherwise infringe the confidentiality of individuals or organisations.
You also agree that NHES and its agencies may hold the personal data submitted below for validation, statistical and billing purposes, and may pass the information on to other parties such as depositors of material contained in the NHES, and copyright and other intellectual property right owners whose material is contained on the Website. You may request copies of data referring to Yourself as held by NHES, and the names of the parties to whom it has been disclosed, on payment of an administrative fee of £10.
5. Service access
While NHES endeavours to ensure that the Website is normally available 24 hours a day, NHES shall not be liable if for any reason the Website is unavailable at any time or for any period. 6. Links to and from other websites
Links to third-party websites on the Website are provided solely for Your convenience. If You use these links, You leave the Website. NHES has not reviewed all of these third-party websites and does not control and is not responsible for these websites or their content or availability. NHES therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If You decide to access any of the third-party websites linked to the Website, You do so entirely at Your own risk and accept that it is Your responsibility to acknowledge and comply with the copyright conditions that may be imposed by these third-party providers.
7. Hyperlinking to NHES
You do not have to ask permission to link directly to pages hosted on the Website. NHES do not object to You linking directly to the information that is hosted on the Website. However, You are not permitted to load anything on the Website onto frames on Your site. The NHES pages must load into the user's entire window.
You shall indemnify and hold NHES harmless from and against any and all liabilities, losses, damages, costs and expenses in relation to any claims or actions brought against NHES based on or resulting from any breach by You of these terms and conditions.
While NHES endeavours to ensure that the information on the Website is correct, NHES does not warrant the accuracy, completeness, content, reliability or availability of the material on the Website. NHES may make changes to the material on the Website at any time without notice. The material on the Website may be out of date, and NHES makes no commitment to update such material.
The material on the Website is provided 'as is', without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, NHES provides You with the Website on the basis that NHES excludes all representations, warranties, conditions and other terms which, but for these terms and conditions, might have effect in relation to the Website.
The mapping resource is designed for information purposes only. In all cases the location and extent of sites and monuments on the Website have no legal standing and are indicative only. NHEMS, any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and any of NHES' officers, employees, or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to You or a third party in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect Your computer equipment, software, data or other property on account of Your access to, use of, or browsing the Website or Your downloading of any material from the Website or any websites linked to the Website.
Nothing in these terms and conditions shall exclude or limit NHES' liability for:
a. death or personal injury caused by negligence; or
b. fraud; or
c. misrepresentation as to a fundamental matter; or
d. any liability which cannot be excluded or limited under applicable law.
If Your use of material on the Website results in the need for servicing, repair or correction of equipment, software or data, You will assume all costs thereof.
NHES reserves the right and the sole discretion to deny You access to the whole or any part of the Website without notice and to decline to provide the service to You if You are found to be in breach of these terms and conditions of use.
